These Terms of Use govern your access to and use of the website at treey.my (the "website") and the services offered on it by TREEY Sdn. Bhd. (Registration No. 202401021708 (1567557-A)) ("TREEY", "we", "us" or "our"). By accessing or using the website, requesting a quotation, or paying for any service, you agree to be bound by these terms. If you do not agree with any part of these terms, you do not have permission to access the website or use our services.

Part A: Use of this website

1. Intellectual Property Rights

The content on our website, including text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of TREEY Sdn. Bhd. or its suppliers and protected by copyright and other intellectual property laws.

2. Use Licence

Permission is granted to temporarily download one copy of the materials (information or software) on TREEY Sdn. Bhd.'s website for personal, non commercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

• modify or copy the materials;
• use the materials for any commercial purpose, or for any public display (commercial or non commercial);
• attempt to decompile or reverse engineer any software contained on TREEY Sdn. Bhd.'s website;
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or "mirror" the materials on any other server.

The restrictions above do not apply to informational articles published on this website that are expressly made available for general reference, including articles describing our own internal procedures or practices. Such articles may be read, referenced, and shared for personal, non commercial purposes, provided the source is acknowledged.

This licence shall automatically terminate if you violate any of these restrictions and may be terminated by TREEY Sdn. Bhd. at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Content on this website, including articles, guides, case studies, and any material describing our own strategies, procedures, or practices relating to search engine optimization (SEO), answer engine optimization (AEO), generative engine optimization (GEO), search engine marketing (SEM), Google Ads, website development, Shopify implementation, tax filings, accounting matters, or regulatory compliance, reflects our own understanding, opinions, and practices as a business and is provided for general informational and reference purposes only.

4. No Guarantee of Results

References on this website to rankings, traffic, conversions, visibility, citations by AI systems, or other performance outcomes, whether in case studies, testimonials, or general content, describe past results for specific clients under specific circumstances and are not a guarantee or prediction of results for any other person.

Search engines, advertising platforms, and AI answer engines (including but not limited to Google, AI Overviews, ChatGPT, Perplexity, and Gemini) operate algorithms and policies that are controlled by third parties, are not disclosed in full, and change without notice. TREEY Sdn. Bhd. does not control these platforms and cannot guarantee any ranking, placement, citation, approval, or outcome on them. Strategies described on this website, particularly those relating to AEO and GEO, address an emerging and evolving area where industry practices are not settled and outcomes cannot be verified or guaranteed.

5. Website Development and Shopify Content

Where this website describes our approach to website development or Shopify store builds, customization, or configuration, such content is provided for general reference only. Implementing changes to a live website or Shopify store, including theme edits, app installations, code changes, or configuration changes, carries inherent risk of errors, downtime, data loss, or unintended effects on site functionality, payments, or third party integrations. Always test changes in a development or staging environment, maintain current backups, and seek assistance from a qualified developer before making changes to a production site based on content from this website.

Part B: Quotations, payment and services

6. Product Pages as Official Quotations

Each service page on this website, including its price, scope, and terms, is TREEY's official quotation for that service. You accept the quotation by paying the first invoice or first instalment for it. The prices, scope, and terms shown on the service page on the date of your first payment apply to your order, together with these Terms of Use. Where a written quotation or invoice issued by TREEY differs from the service page, the written quotation or invoice applies to that order.

7. Prices, SST and Payment

All prices are in Malaysian Ringgit (RM) and exclude 8% Sales and Service Tax (SST) unless stated otherwise. SST is added to every invoice and instalment. Payment is by bank transfer to TREEY's official company account only, as shown on our invoice. TREEY is not responsible for payments made to any other account.

Work starts after we receive the first payment. Fees and instalments paid are non-refundable, except where the law requires otherwise.

8. Late and Unpaid Payments

If any payment is more than 7 days past its due date, TREEY may pause the related service, including taking a landing page or website offline and pausing any advertising campaigns we manage, until the payment is settled. Pausing a service does not reduce the amount owed. TREEY is not liable for any loss of enquiries, sales, or advertising performance caused by a pause for non-payment. Any unpaid balance remains payable, and TREEY may recover it, together with reasonable recovery costs, by any lawful means.

9. Landing Page Package

1. Fee and instalments. The Landing Page package is RM3,300 + SST, payable in 3 monthly instalments of RM1,100 + SST at 0% interest, without a credit card.
2. Payment plan, not a cancellable subscription. The instalments are a payment plan for one fixed fee. Once work starts, the full RM3,300 + SST is payable, even if you stop using the landing page, cancel, or appoint another agency.
3. What the fee covers. Design, build, tracking setup, and the first 12 months of hosting from the date the page goes live.
4. Annual renewal. From month 13, the renewal is RM3,300 + SST per year, payable in advance. The renewal keeps your page hosted and online and includes maintenance on request.
5. Subscription, not ownership. As with Shopify, Instapage, or any hosted website builder, you subscribe to your landing page; you do not buy it. TREEY owns and keeps the page design, layout, code, template, and the copy TREEY writes, whether or not all fees have been paid. These may not be copied, exported, or reused on another platform or by another agency without TREEY's written permission.
6. What you own. You register, renew, and own your domain name directly. You keep ownership of your logo, photos, and other content you provide, and of every lead and enquiry the page sends you.
7. Update requests. While your plan is active, you may make 2 update requests per year. An update request is one message listing all changes, and may cover text, images, colours, or sections. Redesigns and UI revamps are not included. Unused requests do not carry over. Additional requests are quoted separately.
8. Platform. TREEY chooses the hosting platform based on the number of products or services on your page and may change it, provided your page, domain, and tracking continue to work.
9. Ending the service. If the renewal is not paid, or payment is more than 7 days late, the page is taken offline. Your domain, content, and leads remain yours.

10. Google Ads, ChatGPT Ads and Other Advertising Management

1. Scope per plan. Each advertising management plan covers 1 website advertised in 1 country. A second website, or the same website advertised in another country, is a separate scope and requires its own retainer fee, based on the plan chosen for it.
2. Retainer and ad budget. The retainer fee is paid to TREEY. Your advertising budget is paid by you directly to the advertising platform (such as Google or OpenAI) using your own payment method. TREEY does not charge a percentage of your ad spend.
3. Your accounts. Advertising accounts and their data belong to you. TREEY manages them with access that you grant and may remove.
4. No minimum term. Unless a service page states otherwise, advertising management has no minimum contract and may be stopped by either party with notice before the next billing period. Retainer fees already paid for a billing period are non-refundable.
5. Platform decisions. Account approval, ad review, suspension, and policy decisions are made by the platform, not TREEY.

11. Your Responsibilities

You are responsible for the accuracy and legality of the information, claims, prices, images, and content you provide to TREEY for use on any website, page, or advertisement, and for holding the rights to use them. You will compensate TREEY for any claim, loss, or cost arising from content you provide.

Part C: General

12. Disclaimer

The materials on TREEY Sdn. Bhd.'s website are provided on an 'as is' basis. TREEY Sdn. Bhd. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non infringement of intellectual property or other violation of rights.

13. Limitations

In no event shall TREEY Sdn. Bhd. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TREEY Sdn. Bhd.'s website, even if TREEY Sdn. Bhd. or a TREEY Sdn. Bhd. authorized representative has been notified orally or in writing of the possibility of such damage. For any service, TREEY's total liability is limited to the fees you paid to TREEY for that service in the 3 months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

14. Accuracy of Materials

The materials appearing on TREEY Sdn. Bhd.'s website could include technical, typographical, or photographic errors. TREEY Sdn. Bhd. does not warrant that any of the materials on its website are accurate, complete, or current. TREEY Sdn. Bhd. may make changes to the materials contained on its website at any time without notice. However, TREEY Sdn. Bhd. does not make any commitment to update the materials.

15. Links

TREEY Sdn. Bhd. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TREEY Sdn. Bhd. of the site. Use of any such linked website is at the user's own risk.

16. Modifications

TREEY Sdn. Bhd. may revise these terms of use at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of use. For any order, the terms in force on the date of your first payment apply until that order or its current renewal period ends.

17. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Malaysia, and you irrevocably submit to the exclusive jurisdiction of the courts of Malaysia.
